The Products (as defined below) on sale on store.inter.it are distributed by FANATICS ITALY S.r.l., with registered office in Milan, Via Magistretti n. 10 (ZIP: 20128), company registered with the Milan Chamber of Commerce, no. 359848 of the Companies Register – Tax/VAT no. 11670080156 (hereinafter also “FANATICS ITALY”).
FANATICS ITALY is the official licensee of F.C. Internazionale Milano S.p.A.
Trademarks, logos and other distinctive signs of any kind appearing on the site pages belong to their respective owners.
Unauthorized third parties are prohibited from using the trademarks, logos and other distinctive signs on this website, including reproducing them on other websites.
The contents on this site, such as information, texts, graphics and images, are protected by copyright; consequently, any copying or reprinting of any images displayed on this website without the prior written authorization of FANATICS ITALY is prohibited.
The languages available on the site are Italian, English and German.
Every purchase of Products (as defined below) on this website is governed by the following terms:
General Terms and Conditions
ART. 1 – DEFINITIONS
1.1. “Site” means the website store.inter.it, dedicated to the sale of official merchandising on behalf of F.C. Internazionale Milano S.p.A.
1.2. “Customer” means any natural person aged 18 or over, or any legal entity, that makes a purchase on the Site, in accordance with these general terms of sale.
1.3. “Order” means the request form for Products (as defined below) on sale, completed by the Customer on the Site.
1.4. “Products” means the goods on sale on the Site under these general terms of sale.
1.5. “Customized Products” means goods that are customized at the Customer’s request.
1.6. “Price” means the amount payable by the Customer for the Products purchased on the Site.
1.7. “Contract” means the distance sales contract for the sale of Products under these general terms of sale.
1.8. “Parties” means FANATICS ITALY and the Customer.
1.9. “Consumer” means the Customer as a natural person aged 18 or over who acts for purposes unrelated to any commercial, industrial, craft or professional activity.
ART. 2 – CONTRACTING PROCESS
2.1. Products are sold in accordance with the terms and conditions set out in the contract published on the Site at the time the order is placed. Each Contract shall be concluded at the price in force when the Customer submits the Order on the Site.
2.2. To complete a purchase on the Site, the Customer must follow these simple steps:
• I) select the Product, select the size of the Product of interest (where required) and click “ADD TO CART”: a summary of the main features of the selected Product and the total Price due will appear, including shipping costs (excluding any customs duties, where applicable) and taxes;
• II) click “GO TO CHECKOUT” and log in to your account or, if not previously registered on the Site, register on the Site. Alternatively, you can continue the order process as a guest, without prior registration;
• III) complete the order request form (“Order”), indicating the delivery address and choosing the preferred shipping method (where applicable) and payment method; before proceeding to the next step, the Customer must verify the correctness of the data provided. The Customer is responsible for the truthfulness of the data entered;
• IV) read and accept these General Terms and Conditions and the Privacy Notice by clicking the relevant hyperlinks and ticking the box next to “I have read and accept the Terms & Conditions and the Privacy Policy”;
• V) click “CONFIRM AND PAY”: as required by law, the button will indicate that placing the order entails an obligation to pay for the Products ordered.
2.3. Once the purchase is completed, the Customer will receive an Order confirmation email, with these General Terms and Conditions attached, indicating: information relating to the essential characteristics of the Products purchased, the Price of each Product, shipping costs and any other additional costs payable by the Customer, the payment method used, and notice of the right of withdrawal (see Art. 8 below), which may be exercised where the conditions provided by law are met.
2.4. The Contract is deemed concluded and binding on both Parties when FANATICS ITALY sends the Order confirmation to the Customer at the email address provided.
2.5. The Contract is archived, and the Customer may view it by accessing their personal area or by contacting Customer Care.
2.6. The creation and supply of Customized Products offered for sale on the Site is subject to a specific request by the Customer, to be made in accordance with the instructions on the Site. For such Products, advance payment is required and the Customer is not entitled to withdraw from the purchase Contract.
ART. 3 – DELIVERY TIMES AND METHODS
3.1. FANATICS ITALY will arrange delivery by courier of all Products ordered to the address specified in the Customer’s Order.
3.2. Delivery of the Products will take place within 24–48 hours for Italy, within 48–72 hours for other European countries, and within 3 working days for non-EU countries.
3.3. The Consumer Customer is not required to grant FANATICS ITALY the additional time referred to in the preceding Art. 3.3 if:
a) FANATICS ITALY has expressly refused to deliver the Products; or
b) compliance with the delivery term agreed by the Parties must be considered essential, taking into account all the circumstances surrounding the conclusion of the Contract; or
c) the Consumer Customer informed FANATICS ITALY, prior to the conclusion of the Contract, that delivery by or on a specific date is essential.
In such cases, if the Consumer Customer does not receive delivery of the Products within the term agreed with FANATICS ITALY, the Consumer Customer is entitled to terminate the Contract immediately, without prejudice to the right to compensation for damages, and FANATICS ITALY shall refund the Consumer Customer without undue delay all amounts paid in performance of the Contract.
3.4. If one or more Products indicated in the Customer’s Order are no longer available at the time of receipt by FANATICS ITALY of the Order sent by the Customer, for reasons not attributable to FANATICS ITALY, FANATICS ITALY will promptly inform the Customer by email. In such event, the Order is cancelled in full or accepted only with respect to the Products available. In the event of cancellation, if the Customer has already paid the price of the Product(s), FANATICS ITALY will refund in full, without undue delay, the amount paid by the Customer and the related Contract shall be deemed terminated. In the event of partial acceptance, the Customer shall pay (and be charged) only the price relating to the Product(s) available.
3.5. By placing an Order, the Customer represents that the Products ordered are lawful to possess and use in the place where the Customer intends to possess and use them and that they will be possessed or used only in a lawful manner, in compliance with all applicable laws, rules and regulations, including copyright laws; the Customer further represents that they have the right to use any payment method provided. Ordering Products with the intent to resell them is not permitted: the purchase is for personal, non-commercial use only.
ART. 4 – REGISTRATION
4.1. Registration on the Site is not mandatory to purchase Products. The Customer may nevertheless choose to register on the Site; registration is free of charge and does not entail any obligation to purchase. When placing the first order, the Customer may choose to register an account and will receive a generic password. The password can be changed immediately via the link provided in the confirmation email. The Customer must provide complete, correct and truthful data regarding personal information, personal address and, in general, all other information useful for order fulfillment.
4.2. The Customer must keep a copy of the purchase Order confirmation sent by customercare@onlinestore.inter.it to the email address indicated by the Customer during registration on the Site.
ART. 5 – PRICE AND PAYMENT
5.1. Prices are expressed in Euro (€) – conversion into other currencies is indicative and based on the exchange rate at the time of purchase. Prices include VAT in force at the time of the Order and vary according to the type of Products.
5.2. The total Price at the end of the purchase procedure includes shipping costs, but does not include any customs duties or additional charges on the sale necessary to import the Products into a foreign country. Any additional charges relating to customs clearance shall be borne exclusively by the recipient of the shipment.
5.3. Any invoicing request must be made at the time of the order by ticking the appropriate box during checkout.
5.4. Orders placed by Customers in the United States
5.4.1. Products will be shipped on a Delivered Duty Paid (DDP) basis. This means that an amount may be added at checkout to cover the estimated customs duties on the importation of the Products into the United States.
5.4.2. In order to provide DDP service, the Customer agrees that FANATICS ITALY or its subcontractors will act on the Customer’s behalf in relation to the importation of goods, carrying out all customs formalities on behalf of the recipient of the Products.
5.4.3. FANATICS ITALY may request information from the Customer in relation to customs formalities. The Customer must respond to such requests within 5 days of notification; otherwise, the Order may be cancelled.
5.4.4. Sales tax, if applicable, will be added to the Order. This will be shown on the checkout page of the Site and in the emails sent after the Order is placed, after the subtotal for the value of the goods purchased.
ART. 6 – FORCE MAJEURE
6.1. If it is impossible to perform the Contract, in whole or in part, due to a force majeure event, FANATICS ITALY will inform the Customer by email within 30 days from the day the Order was placed and shall not be liable to the Customer, except for refunding any amounts already paid by the Customer.
ART. 7 – COPYRIGHT AND TRADEMARKS
7.1. The Contract does not grant the Customer any rights in trademarks, logos or other distinctive signs of various kinds used or displayed on the Site pages, nor in the related contents.
ART. 8 – RIGHT OF WITHDRAWAL
8.1. Pursuant to Articles 52 et seq. of Italian Legislative Decree 6 September 2005, no. 206, as amended (“Consumer Code”), the Consumer Customer has the right to withdraw from the Contract, without liability and without giving any reason, within 14 days from delivery of the Products (or, in the case of a Contract relating to multiple Products ordered by the Consumer Customer in a single order and delivered separately, from the day on which the Consumer Customer or a third party designated by the Consumer Customer, other than the carrier, acquires physical possession of the last good).
8.2. To exercise the right of withdrawal, within the period indicated in Art. 8.1 above, the Consumer Customer must inform FANATICS ITALY of the decision to withdraw:
– by using the model withdrawal form referred to in Annex I, Part B, of the Consumer Code (attached to these General Terms and Conditions); or
– by submitting any other explicit statement of the decision to withdraw from the Contract.
The form and/or statement may be sent to FANATICS ITALY by email (customercare@onlinestore.inter.it).
8.3. In the event of withdrawal, the Consumer Customer must return the Products received to FANATICS ITALY by shipping them to FANATICS ITALY S.r.l. within 14 days from the date of receipt of the order. The return procedure is indicated on the “returns” page.
8.4. The direct costs of returning the Products shall be borne by the Consumer Customer, including any customs duties.
8.5. The Consumer Customer must return the Products in good condition, without removing the original labels. Returned items must be carefully packed in order to protect the original packaging from any damage, writing or labels. The Consumer Customer is liable for any decrease in the value of the goods resulting from handling other than that necessary to establish the nature, characteristics and functioning of the Products.
8.6. If the right of withdrawal has been exercised in accordance with the above instructions, FANATICS ITALY will refund, within 14 days from receipt of the withdrawal notice, all payments received from the Consumer Customer, only with respect to the Contract to which the withdrawal relates. FANATICS ITALY will make the refund using the same payment method used by the Consumer Customer for the initial transaction, unless the Consumer Customer has expressly agreed otherwise and provided that the Consumer Customer does not incur any costs as a result of the refund. However, pursuant to Art. 56(3) of the Consumer Code, FANATICS ITALY may withhold the refund until the Products have been received or until the Consumer Customer has proved that the Products have been shipped back, whichever occurs first.
8.7. The right of withdrawal may be exercised by a customer acting for purposes unrelated to their entrepreneurial, industrial, craft or professional activity. Therefore, the right of withdrawal is excluded for purchases made by resellers and/or companies.
8.8. The right of withdrawal is also excluded, pursuant to Art. 59 of the Consumer Code, in the case of supply of Customized Products (see Art. 2.6 above), as well as for the supply of sealed Products that are not suitable for return for reasons of hygiene or health protection and/or that have been opened after delivery; as well as for the supply of audio or video recordings that have been opened after delivery.
8.9. No refunds are made for Customized Products (jerseys or shorts with player name or personal name/number, with initials, except for faulty or damaged products); for underwear, swimwear and face masks; for match jerseys if the player leaves the team or changes squad number. Discounted products (seasonal sale or special promotions) are non-refundable.
ART. 9 – CUSTOMER RIGHTS IN CASE OF NON-CONFORMING PRODUCTS
9.1. If the Customer is a Consumer and complains of a lack of conformity of a Product, the Customer is entitled to restoration of conformity by repair or replacement (the Consumer Customer may choose between repair and replacement under the conditions provided by law), or to receive a proportional reduction in the price, or to terminate the Contract, in accordance with Articles 128 et seq. of the Consumer Code. The Consumer Customer has no right to terminate the Contract if the lack of conformity is only minor.
9.2. Following notification by the Consumer Customer under Art. 9.1 above, FANATICS ITALY will, within a reasonable period, arrange for any collection of the Product at the Consumer Customer’s address and, after verifying the alleged defect, proceed with a partial or full refund of the Price. In any case, FANATICS ITALY may propose alternative remedies, such as issuing a voucher corresponding to the amount paid by the Consumer Customer, to be used later by contacting Customer Service; if the Consumer Customer accepts, and without prejudice to the provisions of the Consumer Code, FANATICS ITALY will implement the proposed solution.
9.3. FANATICS ITALY is liable to the Consumer Customer for any lack of conformity existing at the time of delivery of the Product and that appears within two years from that time. Any action to enforce defects not fraudulently concealed by FANATICS ITALY is in any case time-barred within 26 months from delivery of the Product.
ART. 10 – PRIVACY
10.1. The data provided by the Customer and necessary for the performance of the Contract will be processed in compliance with Regulation (EU) 2016/679 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and with Italian Legislative Decree no. 196/2003 on personal data protection. For further information the Customer may consult the Privacy section of the Site.
ART. 11 – COMMUNICATIONS
11.1. All communications between the Parties must be made in writing and sent to the address of the other party indicated in the Contract, with regard to FANATICS ITALY, and in the Order, with regard to the Customer.
11.2. All communications sent to the email address of the other party, as indicated pursuant to Art. 11.1 above, shall be deemed validly made in writing.
ART. 12 – APPLICABLE LAW AND JURISDICTION
12.1. By entering into the Contract pursuant to Art. 2 above, the Parties agree that it shall be governed by and construed in accordance with Italian law. The Parties acknowledge that application of the United Nations Convention on Contracts for the International Sale of Goods is expressly excluded.
12.2. For any dispute concerning the validity, performance or interpretation of the Contract or related thereto, jurisdiction shall lie with:
a) the court of the Customer’s place of residence or elected domicile, if the Customer is a Consumer and is resident or domiciled in Italy;
b) in all other cases, the Court of Milan, Italy, exclusively.
12.3. The Customer may also access the out-of-court dispute resolution platform provided by the European Commission, available at http://ec.europa.eu/odr.
